Lifetime Damage Replacement Promise

We make IMBO Tech leggings to be worn — and we expect you to use them.
Our Lifetime Damage Replacement Promise is an optional benefit designed for those occasions when your leggings suffer genuine accidental damage.
For a one-off payment of A$20, if an eligible pair of IMBO Tech leggings covered by the Promise is accidentally damaged, you can purchase one replacement pair at 50% off the then-current Australian RRP.
Cover starts from the date of purchase and lasts for as long as the original purchaser owns the eligible leggings.
The Lifetime Damage Replacement Promise covers accidental damage. It is separate from our 1-year manufacturer's warranty against manufacturing and material defects and is also separate from your rights under the Australian Consumer Law (ACL).
Your rights under the ACL are not limited to one year and are not affected by purchasing, using or making a claim under the Lifetime Damage Replacement Promise.
Terms & Conditions
1. What you receive
The Lifetime Damage Replacement Promise entitles the original purchaser to purchase one replacement pair of IMBO Tech leggings at 50% off the then-current Australian RRP if an eligible pair covered by the Promise suffers accidental physical damage in accordance with these terms.
Cover applies from the date of purchase.
Once a discounted replacement has been supplied under the Lifetime Damage Replacement Promise, the Promise for that order has been fully redeemed and ends.
2. Cost and eligible products
The Lifetime Damage Replacement Promise costs A$20 per order and must be purchased at the same time as the eligible IMBO Tech leggings.
It cannot be added retrospectively.
End of Line, Clearance, Outlet or other products specifically identified by IMBO Tech as excluded from the Lifetime Damage Replacement Promise are not eligible.
Where an order contains both eligible and excluded products, the Promise applies only to the eligible products within that order.
3. Orders containing more than one pair
Where an order contains multiple eligible pairs of IMBO Tech leggings, one A$20 Lifetime Damage Replacement Promise covers all eligible pairs within that order.
However, the Promise provides a maximum of one discounted replacement pair per order, regardless of the number of eligible pairs originally purchased.
For example, if three eligible pairs are purchased in one order, any one of those three pairs may subsequently qualify for a discounted replacement. Once a replacement has been provided, the Promise has been redeemed and no further claims can be made in respect of the other pairs in that order.
4. What we mean by "Lifetime"
For the purposes of the Lifetime Damage Replacement Promise, "Lifetime" means for as long as the original purchaser owns the eligible leggings.
It does not mean that the leggings themselves are guaranteed to last for the lifetime of the purchaser.
The Promise does not cover a garment simply reaching the end of its reasonable useful life through age, wear, washing or repeated use.
The Promise is personal to the original purchaser and cannot be transferred to another person.
5. What is covered
The Lifetime Damage Replacement Promise covers accidental physical damage caused by a specific event which materially affects the normal use or performance of the leggings.
Cover starts from the date of purchase.
Examples may include accidental tearing, ripping, snagging or other significant physical damage sustained while using the leggings for normal sporting, leisure or everyday activities.
The Lifetime Damage Replacement Promise does not cover:
Normal wear and tear.
Gradual deterioration through age, washing or repeated use.
Gradual loss of elasticity, support or performance through normal use.
Fading, pilling, thinning or abrasion occurring gradually through normal use.
A garment simply reaching the end of its reasonable useful life.
Minor or cosmetic damage which does not materially affect the normal use or performance of the leggings.
Damage caused by incorrect washing or care.
Damage caused by misuse or failure to follow IMBO Tech care instructions.
Deliberate or intentional damage.
Loss or theft.
End of Line, Clearance, Outlet or other products specifically identified as excluded from the Lifetime Damage Replacement Promise.
IMBO Tech will assess claims reasonably and may decline a claim where the damage does not fall within the scope of the Promise.
6. Manufacturer's warranty and Australian Consumer Law
IMBO Tech provides a 1-year voluntary manufacturer's warranty against manufacturing and material defects.
This manufacturer's warranty is additional to, and does not limit, your rights under the Australian Consumer Law.
Your rights under the Australian Consumer Law may continue beyond the period of our 1-year manufacturer's warranty.
The Lifetime Damage Replacement Promise is also an additional benefit. It is intended to provide a discounted replacement following qualifying accidental damage and does not replace, restrict or affect either our manufacturer's warranty or any rights or remedies you have under Australian Consumer Law.
Where a problem may constitute a manufacturing or material defect, or a failure to comply with an Australian Consumer Law consumer guarantee, it will not be treated as an accidental-damage claim merely because you have purchased the Lifetime Damage Replacement Promise.
Making a successful warranty or Australian Consumer Law claim does not use up your Lifetime Damage Replacement Promise.
In simple terms:
Manufacturing or material defect → Manufacturer's warranty and/or Australian Consumer Law rights
Accidental physical damage → Lifetime Damage Replacement Promise
Normal wear and tear or ageing → Not covered by the Lifetime Damage Replacement Promise
7. Making a Lifetime Damage Replacement claim
To make a claim under the Lifetime Damage Replacement Promise, please contact IMBO Tech and provide:
Your original IMBO Tech order number or other satisfactory proof of purchase.
Photographs clearly showing the damaged leggings.
A brief explanation of how and when the accidental damage occurred.
Any additional information reasonably required by IMBO Tech to assess the claim.
We may ask you to return the damaged leggings if reasonably necessary to assess the claim.
If we require the leggings to be returned solely so that we can assess a Lifetime Damage Replacement Promise claim, we will advise you beforehand whether any return costs will apply.
8. Replacement product
Where a Lifetime Damage Replacement Promise claim is accepted, you will be entitled to purchase one replacement pair at 50% of its then-current Australian RRP.
Where reasonably possible, we will offer the same model as the damaged pair.
If the original model is discontinued or unavailable, we may offer the nearest reasonably equivalent current IMBO Tech model.
Replacement is subject to product and size availability.
End of Line, Clearance or Outlet products cannot be selected as the replacement product.
The Lifetime Damage Replacement Promise does not guarantee the continued availability of any particular model, colour, size or design.
9. Promotions and discounts
The 50% replacement discount is calculated against the replacement product's then-current Australian RRP.
The Lifetime Damage Replacement discount cannot be combined with sale pricing, promotional codes, affiliate discounts or other offers.
10. Delivery
Any normal delivery charge applicable to the discounted replacement purchase will be payable by the customer and will be clearly shown before the replacement order is completed.
This provision relates only to a replacement purchased under the Lifetime Damage Replacement Promise and does not limit any rights you may have to recover reasonable costs associated with exercising your rights under Australian Consumer Law.
11. Replacement pairs
A pair purchased using the Lifetime Damage Replacement Promise does not inherit the Promise attached to the original order.
If the scheme is still available, you may purchase a new Lifetime Damage Replacement Promise for the replacement pair.
The replacement pair will have the manufacturer's warranty applicable to new IMBO Tech products at the time it is supplied and will also be subject to the consumer guarantees provided by Australian Consumer Law.
12. Returns of replacement products
A replacement pair purchased at the Lifetime Damage Replacement price remains subject to your rights under Australian Consumer Law and IMBO Tech's applicable returns policy.
Where a refund is payable for a change-of-mind return permitted under our returns policy, the refund will be based on the amount actually paid for the replacement pair.
Nothing in this clause limits any refund or other remedy to which you are entitled under Australian Consumer Law.
13. Cancellation and refunds
If the original order is cancelled and all eligible leggings are returned in accordance with IMBO Tech's applicable returns policy before the Lifetime Damage Replacement Promise has been used, the A$20 payment will also be refunded.
If only some eligible leggings from a multi-pair order are returned, the Promise will continue to apply to the eligible leggings retained by the original purchaser.
Nothing in this clause limits any cancellation, refund or other rights available under Australian Consumer Law.
14. Australian Consumer Law
The Lifetime Damage Replacement Promise and IMBO Tech's manufacturer's warranty provide benefits in addition to your rights and remedies under Australian Consumer Law.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Australian Consumer Law Notice
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

We reserve the right to amend or withdraw the Lifetime Damage Replacement Promise for future purchases.
Any amendment or withdrawal will not affect a Lifetime Damage Replacement Promise already purchased, which will continue to be honoured in accordance with the terms applying when it was purchased.
